Dan is a 69 year old Caucasian male who resides in Midland, Texas. Dan is 5 foot 10 inches tall with a slender statue. His hobbies include collecting antiques, and race care memorabilia. He is well known locally and has had several successful businesses throughout his life. Dan was referred to undergo testing due to changes in his behavior. He was diagnosed with dementia. Dan was considered as an incapacitated adult due to his declining health and diagnoses. He is well known locally and has had several successful businesses throughout his life. Dan was referred to undergo testing due to changes in his behavior. He was diagnosed with dementia. Dan was considered as an incapacitated adult due to his declining health and diagnoses. Dan has been separated from his wife of 30 years for the past 2 years and they have an adult daughter named Amy. Throughout the course of his life Dan was able to acquire wealth, land, and property. Dan has always been known to be a self-made independent businessman.
After the separation with his wife Dan continued to live alone on his property in Midland. Within a year of the separation Dan began to display signs of dementia and making unclear and unsafe decisions, like selling his property in bad business dealings and began to take in transients who have taken advantage of his kindness and have stolen money and property from him. Due to the erratic behaviors his daughter Amy filled court documents to gain guardianship over her father as an incapacitated adult. Due to his dementia diagnoses he lost certain rights and was considered incapacitated. Some of the rights that Dan lost were his right to drive and hold a driver license, own any firearms, manage his finances, engage in a contractual contract or the right to get married. Dan reported (personal communication, April 24, 2018) He’s an adult and does not want to be treated like a child and does not need his daughters help.
Client Issues
The client and his daughter are experiencing a break in their relationship due to the guardianship. Dan recently gained back his right to choose where he can reside. He does have assistance with his daily living needs however since being alone Dan has begun to violate the court orders and has gained access to rights that the court order has taken away from him. Without his daughters knowledge Dan has obtained his driver license and has taken a course to obtain his CHL license which both are in violation of the court order.
Amy is aware of her father having his driver license and has admitted to knowing that he has possession of his car keys. Amy is aware that he no longer has the right to drive, however due to negative communication patterns between her and her father she described being fearful of taking his keys away. Dan has admitted to being verbally abusive to his daughter however he stated that he only lashes out when she tries to treat him like a child and tells him what to do, otherwise they would have a good relationship. Amy reported being hesitant in upholding some of the court orders because when she does her father lashes out at her and the guardianship seems to be what they argue about and feels that it has damaged their relationship.
The family displays circular patterns where the way they interact due to the guardianship have become predictable and the nature of the guardianship has cause maladaptive patterns and has become the theme of their arguments. Dan is unwilling to acknowledge that he needs help due to his declining mental state. He is having a hard time coming to terms that he does need his daughters help. The changes in the family roles have caused an issue between not only Dan and his daughter but as well as his estranged wife. While there are no underage children directly involved in the case the circumstances involving the client has affected his relationship with his daughter as well as his relationship with his estranged wife. Dan is unwilling to relinquish control and is experiencing a power struggle with his daughter which has caused damage to their once close relationship. Neither one of the family members involved are happy with the dynamics of the relationship. They are unable to determine how they can comply with the court order, respect each individual’s needs, and make decisions to suite each member of the families’ best interest.
